The employer must demonstrate – Business is a bona-fide UK trading concern. The vacancy requires at least NVQ3 level abilities. It has not been possible to fill the vacancy from within the home market. The employee must demonstrate – At least 3 years experience in a similar level position. - or - HND equivalent qualification plus 1 year experience, or a Degree with or without experience. In practice it usually means the employer providing accounts, VAT return, certificate of public liability insurance, evidence they are registered with local authority, and brochure, menu and wine list if applicable. A copy of advertising will also be required to prove they have attempted to fill the post from home market. For the employee, letters from previous employers plus copies of certificates/ degrees are required.
How to apply
A UK employer can apply direct to the Home Office for a Work Permit, application forms and guidance notes are available online at www.bia.homeoffice.gov.uk. A non-refundable £190 charge is payable for non EU-elect countries. An Agent or Solicitor can make an application for you. Any agency providing a work permit service must be registered and approved by the OISC, www.oisc.gov.uk . Please note that as from 31 March 2008 we have de-registered from OISC and will no longer be able to send work permit applications on your behalf. We will, however be pleased to advertise your vacancies as usual, submit suitable applicants for your consideration and help with the overall recruitment process but we cannot offer you immigration advice.
